SCOPE OF APPLICATION

The use of the Site by any persons, hereinafter the "Users", whatever the purpose of their visit, is governed by these terms of use, hereinafter the "Terms of Use". The Terms of Use are intended to define the conditions of access, navigation and use of the Site. By accessing and visiting the Site, Users acknowledge to have read the Terms of Use and accept them fully and without reservation.

Cao Luxury reserves the right to adapt or modify the Terms of Use at any time and without notice by posting a new version on the Site. The applicable Terms of Use are those in force on the date of accessing the Site. If any of the clauses of the Terms of Use are deemed null or void by a competent Court, the other clauses shall remain valid.

SITE CONTENT

The Site presents the products and services offered by Cao Luxury. It does not allow for online purchases.

The products are presented on the Site in accordance with current regulations. The Site lists the prices and main characteristics (including dimensions, types of wood, materials and finishes) for Cao Luxury products. The photographs shown on the Website have no contractual value.

Cao Luxury and all the other companies that are involved in the design, creation and publishing of the Site strive to ensure the accuracy and regular updating of the information found on the Site. Due to the number of criteria that can impact the prices (size, choice of fabric, etc.), Cao Luxury cannot guarantee the accuracy of all information mentioned on the Site. Only the information communicated in the official quote has a contractual value. Cao Luxury reserves the right to make improvements and/or changes to the product(s) and services listed on the Site at any time. As a result, Cao Luxury may correct or modify the Site’s content at any time, including the Product prices, without any liability being incurred as a result.

USE OF THE SITE

Each User of the Site guarantees to only use the Site for lawful, private and personal purposes. The Site shall not be used for commercial purposes. It also guarantees that the information and data it provides are accurate, truthful and up-to-date.

Each User agrees to comply with all current laws and regulations.

Cao Luxury may at any time terminate a User’s right to access the Site if he/she does not comply with the Terms of Use or if he/she affects the content or image of the Site and/or Cao Luxury, without prejudice to any damages that may be sought.

HYPERTEXT LINKS

The Site may have hypertext links to other sites or Internet sources. Since Cao Luxury does not control these sites or sources, it cannot be held responsible for their accessibility or for any content, advertising, products, services or other information that they may present.

Any use of hypertext links to the Site require prior authorisation from Cao Luxury, which can be requested through the “Contact" section of the Site.

Cao Luxury also cannot be held responsible for the content of the websites that contain hypertext links to the Site.

INTELLECTUAL PROPERTY RIGHTS

The Site and all the elements it contains (such as trademarks, logos, designs and models, texts, photographs, etc.), including the software elements necessary for the functioning of the Site and databases, are the exclusive property of Cao Luxury.

Any reproduction, representation, adaptation (including translation) or any other use of the Site or its content (whether total or partial) is strictly prohibited, except with prior written authorisation from Cao Luxury. Any infringement shall constitute an act of counterfeiting and/or unfair competition, which may result in civil and/or criminal penalties for the author.

USE OF PERSONAL DATA

When using the Site, Users may be required to provide Cao Luxury with certain personal data (name, email address, telephone number, etc.), including when filling in the “newsletter” or “contact” forms on the Site.

In accordance with the provisions of the “Data Protection Act" of 6 January 1978, each User has a right to oppose, access, modify, delete or rectify his/her personal data. Users can exercise this right by writing to Cao Luxury by mail or email at the following addresses:

In accordance with the provisions of Articles 38 et seq. of the French Data Protection Act 78-17 of January 6, 1978, all users have the right to access, rectify and object to any personal data concerning them, by sending a written and signed request, accompanied by a copy of the identity document bearing the signature of the holder of the document, and specifying the address to which the reply is to be sent.

No user's personal information on the www.caoluxury.com site is published without the user's knowledge, exchanged, transferred, assigned or sold on any medium whatsoever to third parties. Only the assumption of the purchase of CAO Design LDA and its rights would allow the transmission of the said information to the eventual purchaser who would in turn be bound by the same obligation of conservation and modification of the data with respect to the user of the www.caoluxury.com site.

The site has not been declared to the CNIL, as it does not collect personal information.

Users are informed that cookies may be automatically installed on their computer’s hard drive when visiting the Site.

Cookies are pieces of data used by web servers to send status information to a user's browser and return browser status information to the original web server. The status information includes the User’s browsing history on the Site, such as the pages visited, path travelled, date and time of consultation, duration of the consultation, session identifiers, language used, etc.

Users of the Site acknowledge that they have the skills and means necessary to access and use the Site. The hardware and software required to access the Internet and the Site are solely the User’s responsibility.

Cao Luxury offers access to the Site free of charge and therefore declines any responsibility in case of Site interruptions, computer bugs, display/download errors, or any damage resulting from a fraudulent intrusion by a third party.

Users use the Site under their own responsibility. Cao Luxury cannot be held responsible for any inconvenience or damage related to the use of the Internet network, including data losses, service interruptions, external intrusions, or computers viruses.

APPLICABLE LAW AND JURISDICTION

Any complaint related to the Site must be sent by email to Cao Luxury at the following address: info@caoluxury.com. Cao Luxury will strive to respond as soon as possible.

THE TERMS OF USE ARE GOVERNED BY PORTUGUESE LAW.

Any dispute relating to the Terms of Use or any use of the Site shall be subject to the exclusive jurisdiction of the Portuguese Courts, notwithstanding plurality of defendants or the introduction of third parties.
